STYVU Terms of Service

These Terms of Service ("Terms") govern your access to and use of STYVU, including the STYVU mobile application, website, AI image generation features, wardrobe tools, subscription features, and related services (the "Service").

1. Who We Are

STYVU is operated under the STYVU brand ("STYVU," "we," "us," or "our"). If STYVU is later incorporated, reorganized, sold, or transferred to a company or successor entity, we may assign these Terms and the Service to that entity.

2. Acceptance of Terms

By using STYVU, creating an account, starting a trial, purchasing a subscription, uploading content, or generating AI results, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

Additional terms may apply through app stores, sign-in providers, subscription management providers, AI model providers, backend providers, cloud infrastructure providers, diagnostics providers, security providers, or other third-party providers used to operate the Service.

3. Eligibility

You must be at least 18 years old to use STYVU. The Service is not directed to children or individuals under 18. By using STYVU, you represent that you are legally able to enter into these Terms.

4. What STYVU Does

STYVU is an AI-powered virtual wardrobe and styling application. It may allow you to upload or select photos, import garment references, organize wardrobe items, create outfit projects, use virtual try-on and collage features, generate AI images, sync certain data, and manage subscriptions or credits.

We may add, remove, limit, suspend, or modify features, models, plans, credit rules, or availability at any time.

5. Accounts

You may sign in using supported methods such as third-party sign-in, email/password, or other authentication options. You are responsible for keeping your account secure and for all activity under your account.

Some features may be unavailable to anonymous, trial, unpaid, suspended, or limited accounts.

6. User Content

"User Content" means photos, images, garment references, prompts, text, files, wardrobe data, projects, and other materials you upload, import, submit, or create through STYVU.

You retain ownership of your User Content. You grant STYVU a limited, worldwide, non-exclusive license to host, store, process, transmit, transform, display, and use your User Content only as reasonably necessary to provide, operate, secure, troubleshoot, improve, and support the Service, comply with law, and enforce these Terms.

You represent that you have all rights, permissions, and consents required for your User Content, including consent from any identifiable person shown in an uploaded image. You must not upload content that violates privacy, intellectual property, publicity, consumer protection, or other rights.

7. AI Processing and AI Results

STYVU uses third-party AI model providers, cloud infrastructure and storage providers, backend and authentication providers, subscription and payment platforms, diagnostics providers, security providers, and other service providers to operate the Service. Your inputs and outputs may be processed by these providers depending on the feature, model, plan, region, and technical route used. Specific providers may vary over time and may be identified where required by law, platform rules, or a valid privacy request.

AI-generated results may be inaccurate, incomplete, unexpected, offensive, visually distorted, or similar to results generated for other users. STYVU does not guarantee that AI results will preserve exact identity, body shape, fit, sizing, colors, fabrics, product availability, or real-world appearance.

STYVU is a creative visualization and styling tool, not a body measurement, tailoring, sizing, product verification, or fit-guarantee service. AI results are illustrative and may not reflect actual body proportions, garment size, fit, drape, texture, material, color, brand details, availability, or real-world appearance.

Output resolution, file size, aspect ratio, and visual quality may vary depending on the feature, plan, source image, model, processing route, device, and technical limitations. Any references to 1K, 2K, or similar output levels describe approximate maximum or target output sizes, not a guarantee of identical pixel dimensions, print quality, product accuracy, or suitability for every use.

You are responsible for reviewing AI results before relying on, sharing, publishing, or commercially using them. AI results are not medical, legal, financial, mental health, body image, or other professional advice.

8. Acceptable Use

You may use STYVU only for lawful, safe, and authorized purposes. You must not use the Service to:

  • violate any law, regulation, or third-party right;
  • upload images of a person without appropriate rights or consent;
  • create non-consensual intimate, sexualized, exploitative, deceptive, or abusive content;
  • create or manipulate images of minors;
  • harass, defame, impersonate, deceive, or harm another person;
  • infringe intellectual property, privacy, publicity, or confidentiality rights;
  • bypass, disable, or interfere with safety systems, usage limits, rate limits, or security controls;
  • reverse engineer, scrape, extract, copy, or replicate the Service, prompts, templates, models, systems, or non-public functionality;
  • use STYVU or its outputs to develop, train, benchmark, or improve a competing AI model or virtual try-on system;
  • upload malware, spam, automated abuse, or unauthorized scraping tools;
  • use the Service for regulated professional advice, clinical use, medical diagnosis, legal advice, financial advice, or other high-risk decisions.

We may remove content, restrict generation, suspend accounts, or terminate access if we believe these Terms, provider policies, or applicable law may be violated.

9. Credits, Trials, Subscriptions, and Consumer Rights

STYVU may use credits to access AI generation or premium features. Credit costs may vary depending on model, feature, number of images, quality level, processing cost, or plan.

Free, demo, promotional, referral, or trial credits may be limited, non-transferable, unavailable in some regions, and may expire or be revoked. Subscription credits are generally available only while your subscription is active and may not roll over unless expressly stated in the app.

Credits may be consumed when an AI generation, background removal, export, or other credit-based action begins. Because these features involve digital processing that may start immediately after you request it, consumed credits, completed generations, and started digital services are not refundable except where required by applicable law, App Store policy, or the specific refund rules shown in the app.

If a generation fails for technical or safety reasons, STYVU may refund credits according to the in-app status and our internal rules. Dissatisfaction with an AI result does not automatically entitle you to a credit refund.

If you are a consumer in a jurisdiction that grants mandatory cancellation, withdrawal, refund, or other consumer rights, those rights remain available to the extent required by law. Where legally permitted, by requesting immediate access to digital features, you acknowledge that the service may begin right away and that withdrawal or cancellation rights may be limited once digital content or processing has started.

10. Payments and App Store Subscriptions

STYVU subscriptions and in-app purchases may be processed through the Apple App Store, StoreKit, and subscription management providers. Prices, trial terms, renewal terms, taxes, and billing periods are shown before purchase.

Subscriptions renew automatically unless cancelled through your Apple account before renewal. Deleting the app or deleting your STYVU account does not automatically cancel your Apple subscription. Refunds, billing disputes, and payment issues for App Store purchases are handled by Apple according to Apple's policies.

STYVU cannot directly cancel a subscription purchased through Apple or guarantee a refund for an App Store purchase outside Apple's refund process. You are responsible for managing renewal, cancellation, and refund requests through your Apple account or the App Store support flow, except where applicable law requires another remedy.

If one-time credit packs are offered, the purchase screen will state the pack size, price, availability, and any expiration or usage restrictions.

11. Account Deletion

You may request account deletion through the app or by contacting us. If you have an active App Store subscription, you may need to cancel it through Apple before account deletion can be completed. If your subscription remains active until the end of a paid period, deletion may be scheduled after that period ends.

Account deletion may remove your STYVU profile, server-side account data, generation records, and related records under our control. Some data may remain where required or permitted by law, security, fraud prevention, backups, provider logs, tax/accounting obligations, App Store records, or technical limitations. Local device data, iCloud data, and Apple purchase history may need to be managed separately by you through your device, iCloud, or Apple account.

12. Intellectual Property

STYVU, including its app, website, interface, software, workflows, templates, prompts, brand, logos, backend systems, and documentation, is owned by STYVU or its licensors and is protected by intellectual property laws.

You may not copy, sell, sublicense, modify, reverse engineer, or create derivative works from STYVU, except to the extent expressly permitted by these Terms, the applicable App Store terms, or mandatory applicable law.

You are responsible for ensuring that your use of AI results does not infringe third-party rights, including rights in people, brands, products, garments, artwork, trademarks, or copyrighted images.

If you send us feedback, suggestions, ideas, feature requests, or other comments about STYVU, you allow us to use them to operate, improve, market, or develop STYVU without owing you compensation, attribution, approval, or any obligation to implement them.

13. Third-Party Services, Links, and Social Media

The Service depends on third-party platforms and providers, including app stores, AI providers, cloud infrastructure, authentication providers, analytics/crash reporting providers, and payment services. We are not responsible for third-party services, outages, policies, pricing, or data handling outside our control.

Your use of third-party services may be governed by their own terms and privacy policies.

STYVU may link to websites, social media pages, app stores, support pages, or other services that we do not operate. Interactions with those third-party services, including Instagram, Apple, payment providers, sign-in providers, and AI providers, are governed by their own terms and privacy policies.

14. Privacy

Our Privacy Policy explains how we collect, use, store, process, and share information. By using STYVU, you also agree to the Privacy Policy.

15. Availability and Changes

STYVU may be unavailable, delayed, interrupted, or limited due to maintenance, provider outages, model capacity, safety reviews, regional restrictions, legal requirements, or technical issues.

We may limit availability in certain regions if required by law, platform rules, AI provider terms, payment availability, or operational constraints.

16. Termination and Suspension

We may suspend, restrict, or terminate your access to STYVU if you violate these Terms, create risk for STYVU or others, misuse credits or subscriptions, trigger security or fraud concerns, violate provider policies, or if required by law or platform rules.

You may stop using STYVU at any time. Subscription cancellation must be handled through the relevant app store or payment provider.

17. Reports, Complaints, and Appeals

You may report content, generated outputs, account activity, intellectual property concerns, privacy concerns, non-consensual imagery, illegal content, or other misuse by contacting [email protected].

Please include enough information for us to review the issue, such as your contact details, the relevant account or request ID if available, a description of the concern, the content or output involved, and why you believe it violates these Terms, the law, or someone else's rights.

We may acknowledge, review, remove or restrict content, limit features, suspend accounts, preserve evidence, notify affected users where appropriate, or take no action if the report is incomplete or unsupported. If your content or account is restricted and you believe the decision was made in error, you may contact us to request a review unless providing an appeal would create safety, fraud, or legal risk.

18. Disclaimers

STYVU is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

We do not guarantee that AI outputs will be accurate, realistic, lawful for your intended use, unique, commercially usable, free from third-party claims, or suitable for publication.

19. Limitation of Liability

To the fullest extent permitted by law, STYVU and its owner, operators, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, content, business, or opportunities.

To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of: (a) the amount you paid to STYVU in the three months before the claim arose; or (b) USD $50.

Nothing in these Terms excludes or limits liability, remedies, warranties, or consumer rights that cannot be excluded or limited under applicable law, including rights that may apply to consumers in the EU, EEA, UK, or other jurisdictions with mandatory consumer protection rules. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

20. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless STYVU from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, your AI results, your misuse of the Service, your violation of these Terms, or your violation of law or third-party rights.

21. Apple App Store Terms

If you downloaded STYVU from the Apple App Store, these Terms are between you and STYVU, not Apple. Apple is not responsible for the Service, maintenance, support, claims, or liabilities related to STYVU.

Your license to use STYVU is limited to use on Apple-branded devices that you own or control, as permitted by Apple's App Store terms. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

22. Governing Law and Disputes

These Terms are governed by applicable law, except where mandatory consumer protection laws require otherwise. Courts of competent jurisdiction may hear disputes, and nothing in these Terms limits any mandatory rights you have to bring claims in another forum under applicable law.

Nothing in these Terms affects rights, remedies, or protections that cannot be waived or limited by contract under the law that applies to you.

23. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a new "Last updated" date. Your continued use of STYVU after changes become effective means you accept the updated Terms.
